Changes to the Porta 65 - Youth programme - Decree-Law no. 42/2024, of 2/7

 

Decree-Law 42/2024 was published on 2 July 2024, which extends access to the Porta 65-Jovem programme, created and regulated by Decree-Law 308/2007 of 3 September.


With the publication of Decree-Law 42/2024, the following changes stand out, which will come into force on 1 September 2024, according to article 4 of the Decree-Law:

a) the maximum income allowed as an application requirement is eliminated;

b) support can now be granted before the lease contract is signed; and

c) a monthly cycle application system is created, with applicants sorted on the basis of income and household;

d) young people aged 35 and over are now eligible.


To summarise:


1.

Article 7(2)(a) and (b) of Decree-Law 308/2007 of 3 September are repealed, thus eliminating the following requirements:

"b) None of the young people or members of the young household own or rent for residential purposes another building or housing fraction;

c) None of the young people or members of the young household are related to the landlord in a direct or collateral line;"

Article 3(d) of Decree-Law no. 308/2007, of 3 September, is added, now providing for the 'Maximum Reference Rent (RMR)', as being the "general rent price limit by typology, provided for in article 10(1)(a) of Decree-Law no. 68/2019, of 22 May, in its current wording, or, whenever more favourable to the applicant, the rent limits set out in table II of the annex to Ministerial Order no. 277-A/2010, of 21 May, in its current w

Article 4(1)(a), (b) and (c), as well as Article 4(3) of Decree-Law 308/2007, of 3 September, are amended to provide for an age of 35 or 36 during the period in which support is granted;

Article 5(10) and (12) of the aforementioned Decree-Law 308/2007, of 3 September, are now amended to provide for the possibility of presenting the income of the last three months prior to the application, instead of the six months currently in force;


5.

Article 7(7) of the aforementioned Decree-Law 308/2007, of 3 September, now makes it a condition of payment of the support that the rental contract be registered within two months of the results of the application being published, under penalty of exclusion, thus excluding the need to sign a rental agreement, in accordance with the legislation in force;
